Force Majeure
This notice sets out how events beyond our reasonable control affect the "England vs Norway" conditional promotional giveaway (the "Promotion") operated by Aetheria Media Holdings S.r.l. ("we", "us", "our").
1. Definition of Force Majeure
1.1. "Force majeure" means any event beyond our reasonable control, including but not limited to:
- natural disasters, extreme weather, earthquakes, floods, or fire;
- epidemic, pandemic, or public-health emergency;
- war, armed conflict, terrorism, civil unrest, riot, or insurrection;
- strikes, lockouts, labour disputes, or other industrial action;
- failure of utilities, electricity, telecommunications, or internet services;
- hosting, cloud, or data-centre outages;
- cyber-attack, distributed denial-of-service attack, or other malicious interference with systems;
- acts, interventions, regulations, or restrictions of government, regulators, or public authorities;
- failure or delay of third-party service providers that we could not reasonably prevent; and
- any other event that prevents us from safely, lawfully, or fairly conducting the Promotion or paying prizes.
1.2. A force majeure event includes any event that prevents us from performing our obligations under the Promotion in a timely, secure, or lawful manner.
2. Effect on the Promotion
2.1. We are not liable for any delay or failure to perform our obligations under the Promotion to the extent caused by a force majeure event.
2.2. Where a force majeure event prevents the fair or lawful conduct of the Promotion, we may, subject to applicable law and your mandatory consumer rights:
- suspend the Promotion for a limited period;
- extend the Entry Window or verification deadlines;
- modify the Promotion to address the effects of the event; or
- cancel the Promotion in whole or in part.
2.3. If we cancel or suspend the Promotion due to force majeure, we will use reasonable efforts to communicate the position through the website and, where appropriate, to entrants by email.
3. Match Integrity and the Trigger Condition
3.1. Where a force majeure event affects the Match itself (for example, abandonment, postponement, or cancellation), the Trigger Condition is assessed by reference to the official recorded result of the Match.
3.2. If no valid official loss by England is recorded by the Competent Football Authority, the Promotion is deemed not triggered and no prize is awarded.
3.3. If the Match is rescheduled or replayed, the Trigger Condition applies to the official result of the rescheduled or replayed Match, as determined by the Competent Football Authority and announced by us.
4. Communication and Mitigation
4.1. Where reasonably practicable, we will communicate material force majeure impacts on the Promotion through this website and, where appropriate, by email to entrants.
4.2. We will use reasonable efforts to mitigate the effects of any force majeure event and to resume the Promotion as soon as it is fair, lawful, and practicable to do so.
5. No Additional Compensation
5.1. Except where required by law, no compensation, damages, or alternative prize is payable for cancellation, suspension, or delay caused by a force majeure event.
